DANVILLE PLANNING AND ZONING COMMISSION MINUTES
March 6, 2008
A meeting of the Danville Planning and Zoning commission was held on
Thursday
March 6, 2008, in the Community Room, 17 West Main Street, Danville,
Illinois.

Chairman Ken Cunningham called the meeting to order at 5:15 p.m.
Tracy Taylor made a motion to approve the minutes from the January 3, 2008
and February 7, 2008 meetings; seconded by Mark Goodwin.

Special Use Permit # 192 James Miller is requesting a special use permit to
place a mobile home at 2223 N 1525 East Rd in the A-2 Zoning District.
Petitioner: James Miller explained his plan to place a mobile home on the
19.9 acres for his own residence. He plans to build a single family dwelling
on the land in 3 – 5 years; at that time the mobile home will be removed.
Department Recommendation:
Christopher Milliken: reported that two neighbors had contacted the city
with questions but they were not opposed to the plan. Since this is a
special use the department reminded the commission that a condition could be
placed on the special use permit such as a time limit for removal of the
mobile home.
Motion made by Mark Goodwin to adopt the finding of fact in the staff report
& approve the special use permit with a 5 year term for removal of the
mobile home.

Motion carried: Special use permit 192 approved
Zoning petition # 215 – Teepak Credit Union is requesting that the zoning of
102 Porter be changed from R-2 single family residential, medium density to
B-2 highway business for the purpose of utilizing the existing building at
this location for meeting space and storage.
Presenting the petition: Kevin Kennedy, manager of the credit union, spoke
about the plan to remodel the vacant building which was previously a
Laundromat and use it for storage and meeting room space. There will not be
a kitchen or food prep, the room will not be rented to the public. Roofing,
painting and landscaping will be done.
Opposition to the Petition: Anthony Dye, owner of 104 Porter, spoke
concerning the denial he received last year from the City Council to his
request to rezone that property from R-2 to B-2 for the purpose of operating
a detail shop. He is not opposed to this change in zoning but if it is
approved by the City Council he is requesting an explanation for his denial.
He said he has spent $25,000 in renovations to the property and cannot use
it without the rezoning. He is opposed to any vacation of the north/south
alley as he believes that would devalue his property and be a detriment to a
business on his property.
Response: Kevin Kennedy explained that the only alley vacation planned is
the east/west alley between the two properties owned by the credit union, so
as to allow easier parking access to 102 Porter property.
Department Comments: Christopher Milliken reported that the department
supports this petition; the rezoning would match the credit unions adjoining
property. It would be using an existing vacant commercial building; it would
not create utility or traffic issues.
Motion made by Mark Goodwin to approve the finding of fact and also to
approve the rezoning petition.

Motion carried: Petition approved
Chris Milliken presented proposed changes to zoning districts and formatting
of the table of uses and table of area/bulk standards. There was a general
discussion concerning the definitions of zoning districts and the zoning
ordinance revisions in general.
The Revised commission Rules of Practice were distributed for review and to
be adopted at a later meeting.
The meeting was adjourned at 6:15p.m.
