(CARBON MONOXIDE DETECTOR ALARM ACT)

PROCEDURES


REQUIREMENT

Owner’s Responsibility: Effective January 1, 2007, all property owners within the city limits of Danville are required to have installed within each structure a Carbon Monoxide Detector within 15ft of every room used for sleeping purposes. Furthermore, the owner must provide written information regarding the detector testing and maintenance to the occupant of each rental unit.

Tenant’s Responsibility: The tenant must test, maintain and replace the batteries when needed in the detector. The tenant must notify the owner in writing of any problem and permit the owner access to the detector to correct the problem.

Willful failure to install or maintain in operating condition any carbon monoxide alarm required by this Act is a misdemeanor. Tampering with, removing, destroying, disconnecting, or removing the batteries from any installed carbon monoxide alarm, except in the course of inspection, maintenance, or replacement of the alarm, is a misdemeanor in the case of a first conviction and a felony in the case of a second or subsequent conviction.

ENFORCEMENT RESPONSIBILITY

The Danville Fire Department (DFD) is ultimately responsible for the enforcement of this Act with assistance from the Public Development Department, Property Maintenance Inspections Section (PMIS).

PROCEDURES FOR REPORTING VIOLATIONS

Any person can report a violation of this act to the DFD or the PMIS at the following numbers:

EXEMPTION TO THE REQUIREMENT

The occupancy or structure does not rely on combustion of fossil fuel to cook, heat, ventilate or produce hot water; is not connected in any way to an enclosed garage; and is not sufficiently close to any ventilated source of carbon monoxide, as determined by the local building commissioner or authority having jurisdiction, to receive carbon monoxide from that source.
